Terms of Service
Last Updated: August 29, 2026
1. Acceptance of These Terms
These Terms of Service govern your access to and use of the LibraryStu website, application, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
If you use the Service on behalf of a library or another organization, you represent that you have the authority to accept these Terms on behalf of that organization.
2. Eligibility and Administrator Responsibilities
You are responsible for maintaining the confidentiality and security of your account credentials and for activities conducted through your account.
You agree to provide accurate information and to promptly update information that becomes inaccurate or outdated.
You must not use LibraryStu for unlawful, fraudulent, harmful, or unauthorized purposes or in a manner that interferes with the security or operation of the Service.
3. Student Data and Children
Library Administrators retain control over Student Data entered into LibraryStu and are responsible for ensuring that they have the lawful authority and an applicable legal basis required to provide that data to LibraryStu for processing.
Where applicable law requires consent, the Library Administrator is responsible for obtaining and maintaining such consent. Where applicable law requires verifiable parental or guardian consent for the processing of a child's personal data, the Library Administrator is responsible for obtaining and maintaining the required consent before entering that data into the Service.
Library Administrators must not enter personal data that they are not legally authorized to collect, use, or provide to LibraryStu.
4. Device Permissions and Location Services
To provide specific features of the Service, such as smart attendance tracking, LibraryStu may request access to your device's camera and precise geolocation data.
- Location Data: Geolocation and GPS coordinates are used exclusively to verify physical check-ins at the library premises. We do not continuously track background locations.
- Camera Access: Camera permissions are required strictly for scanning QR codes during the attendance check-in process. LibraryStu does not record, store, or transmit unauthorized photos or video feeds.
By enabling and utilizing these features, you consent to the collection and use of this information as further described in our Privacy Policy. You may revoke these permissions at any time through your device settings, though this may limit your ability to use certain features of the Service.
5. Your Data and Our Processing Role
For Student Data entered into the Service, the relevant library generally determines the purposes and means of processing and LibraryStu generally processes that data on behalf of the library to provide the Service, subject to applicable law and our agreements with the library.
LibraryStu may use service providers and sub-processors to provide infrastructure and services necessary to operate, secure, support, and maintain the Service.
The collection and processing of personal data are further described in our Privacy Policy.
6. Subscription Billing and Payments
Subscription fees are billed in advance according to the plan and billing cycle presented to you at the time of purchase. Subscriptions do not automatically renew, and manual purchase is required to extend access past the expiry date. Payments may be processed through an authorized payment provider, including Razorpay.
If a payment fails, is declined, or remains unpaid, LibraryStu may suspend or restrict access to the Service until the outstanding payment is resolved.
Payment processing may depend on third-party payment networks, banks, UPI providers, and other financial institutions. LibraryStu is not responsible for failures or delays caused solely by those third parties, except to the extent required by applicable law.
You may stop using the Service at any time. You may also request cancellation of your active subscription at any time; however, cancellation does not automatically entitle you to a refund. Unless otherwise required by applicable law, fees paid for an active billing period are non-refundable and access remains active until the end of the applicable paid billing period. Verified duplicate charges or billing errors may be reviewed and corrected in accordance with our Cancellation & Refund Policy.
7. Suspension and Termination
We may suspend, restrict, or terminate access to the Service where reasonably necessary to protect the Service, our users, security, our rights, or legal compliance, including where we reasonably believe that the Service is being used unlawfully, fraudulently, or in violation of these Terms.
Suspension or termination does not automatically require us to retain data indefinitely. Data may be deleted or retained in accordance with our Privacy Policy, applicable law, security requirements, and legitimate business purposes.
8. Availability and Changes to the Service
We strive to provide reliable access to LibraryStu, but we do not guarantee uninterrupted, error-free, or completely secure operation.
The Service may occasionally be unavailable because of maintenance, updates, technical issues, internet or telecommunications failures, third-party service failures, or circumstances beyond our reasonable control.
We may modify, update, add, remove, or discontinue features of the Service from time to time. Where a change materially affects your use of a paid Service, we will provide notice where reasonably practicable or required by applicable law.
9. Intellectual Property
LibraryStu and its software, interfaces, designs, branding, content, logos, trademarks, and other proprietary materials are owned by or licensed to LibraryStu and are protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
You may not copy, reproduce, modify, distribute, sell, lease, sublicense, reverse-engineer, decompile, or disassemble the Service except to the extent expressly permitted by applicable law.
10. Limitation of Liability
To the maximum extent permitted by applicable law, LibraryStu shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, business opportunity, or data, arising from or relating to the use of or inability to use the Service.
Except where prohibited by applicable law or arising from our fraud or willful misconduct, LibraryStu's total aggregate liability arising from or relating to the Service shall not exceed the subscription fees actually paid by you for the three months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
11. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless LibraryStu from third-party claims, losses, damages, liabilities, and reasonable expenses arising directly from your unlawful use of the Service, your breach of these Terms, or your failure to have the lawful authority or applicable legal basis required to provide Student Data to LibraryStu.
12. Force Majeure
LibraryStu shall not be liable for delays or failures to perform obligations caused by events beyond our reasonable control, including natural disasters, war, civil disturbances, government actions, widespread internet or telecommunications failures, power outages, labor disputes, or failures of third-party infrastructure providers.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Service, technology, business practices, or applicable law. When changes are made, we will update the "Last Updated" date and may provide additional notice where appropriate or required.
Continued use of the Service after the effective date of an updated version of these Terms will be subject to the updated Terms, except where applicable law requires a different process.
14. Dispute Resolution and Governing Law
These Terms are governed by the laws of India, subject to mandatory provisions of applicable law.
Before commencing formal legal proceedings, the parties should attempt in good faith to resolve the dispute through informal discussions.
Subject to applicable law and the jurisdiction of competent courts, disputes arising from or relating to these Terms or the Service shall be subject to the jurisdiction of the competent courts having territorial jurisdiction in Mainpuri, Uttar Pradesh.
